The National Industrial Court on Tuesday adjourned the Federal government suit against the Academic Staff Union of Universities until March 28 for ruling.

The claimants, Federal Government and the Minister of Education, had dragged ASUU before the court in August 2022 over the then strike, for interpretation and application of some Trade Dispute Act.
The matter before the president of the court, Justice Benedict Kanyip, came up on Tuesday for hearing of the defendant’s preliminary objection.

However, when the matter was called, the defence counsel, Mr Femi Falana, SAN, informed the court that his process on Reply on Point of Law could not be filed on Monday at the court’s registry due to internet issue.
He, therefore, sought for the leave of court for a short adjournment.
The judge in response stepped down the matter until 1.00 pm to enable the counsel properly file his process and serve on the claimants’ counsel.

When the court resumed, Falana applied for his motion dated and filed Sept. 19, 2022, seeking for the leave of court for extension and his Reply on Point of Law filed Tuesday to be deemed as properly filed.

He further proceeded to inform the court that his preliminary objection was premised on jurisdiction of the court and he relied on order 3 rule 6 of the TDA to argue that the Minister of Labour and Employment did not follow due process before issuing the referral to the court.

He stated that reconciliation steps were not duly followed and that the Minister could approach the court if parties of a Trade Union could not resolve their differences.

The counsel to FG and Minister of Education, J.U.K Igwe, SAN in response to Falana’s submission, stated that Falana’s reply which he received five minutes before the court’s proceeding was on reply of facts and not on law.
He further stated that all the authorities cited by the counsel did not have any relevance to his application.


Igwe, in addition, stated that the defence counsel should have sought for the leave of court to file a counter-affidavit.

He also said the National Industrial Court with its exclusive jurisdiction on industrial matter had the jurisdiction to entertain the matter.

Igwe stated that the minister did not act out of the ordinary as order 3 rule 6 of the TDA conferred on him the power to refer the matter to NICN.

He added that the matter was also of national interest. He concluded by urging the court to discountenance the defence counsel’s objection.

The judge, therefore, adjourned the matter until March 28 for ruling.

The PUNCH reports that the Minister of Labour and Employment, on behalf of the Federal government, had filed the matter before the court by way of referral for the court to resolve the issue of the strike and for interpretation of certain sections of the TDA.

The court on its part on September 21, 2022 directed the defendant to end its strike and return to work.


The vacation judge who had presided over the matter after delivering ruling on the interim injunction returned the file to the president of the court for reassignment for the hearing of the substantive suit.

A federal high court sitting in Abuja, on Thursday, ordered the permanent forfeiture of 22 properties in Lagos State to the Federal Government.

The court had, on November 16, 2021, granted the Federal Government’s application for interim forfeiture.

But the Lagos government, through its attorney-general, Moyosore Onigbanjo, and Patrick Ibikunle Fanfunwa, the Onikoyi of Lagos, had filed applications to show reasons why the properties should not be permanently forfeited to the Federal Government.

The forfeiture covers landed property in locations as follows: an approximately 4.222 square meter at Admiralty Way, Lekki Phase 1 beside the substation; approximately 1.700 square meters with twin duplex uncompleted in Victoria Gardens City estate; No. 2a/2b Kuramo close, Ikoyi; as well a warehouse at Wharf road, Apapa.

It also includes property along Muritala Muhammed airport, domestic wing of airport transit/protocol office, Ikeja; empty fenced land at 13b, McDonald road, Ikoyi; 20, Gerrard, Ikoyi; Plot 001, Awolowo road, Ikoyi; 3, Macpherson Ikoyi; two-bedroom, flat F at Block 25, Ladoke Akintola street; one duplex at 11, Alexander Avenue, Ikoyi; Plot 24/25, Sango House, Marina; 32, Queens Drive, Ikoyi; and detached storey house of four-bedroom with three rooms, BQ at block 11, ljora staff quarters, Ijora GRA, among others.

Court orders forfeiture of 14 properties linked to Kogi govt
Delivering a ruling on the applications on Wednesday, Inyang Ekwo, the presiding judge, held that the Federal Government’s case succeeded on merit.

He said Lagos and the traditional ruler could not substantiate the claims made in their affidavits and that it was made in absolute bad faith.


The judge held that they never challenged the claims made by the federal government.

“The law insists that where facts deposed to in an affidavit have not been controverted, such facts must be taken as true,” he said.

Consequently, Ekwo ordered that all the property listed on the face of the motion on notice be finally forfeited to the Federal Government

The modern Lekki deep seaport has been commissioned today Monday, January 23rd, 2023 by President Mohammad Buhari, after the port had undergone about two years of construction, which officially commenced on June 15th 2020.

The President also handed over the port to Tolarams Group for 45 years. The seaport constructed by China Harbour Engineering Lekki Free Trade Zone LFTZ Enterprises (CHELE), a subsidiary of China Harbour Engineering Company, was billed to be completed by October 2022.

It is believed to be the deepest in Nigeria and one of the deepest in West Africa with a draft depth of 16.2 metres in-depth and annual cargo tonnage of four million tons and annual container volume of 2.5 million teu.

However, prior to President Muhammadu Buhari’s commissioning of the deep seaport, the Nigerian Ports Authority (NPA) berthed a CMA-CGM container vessel to the port. The vessel is reputed to be one of the largest container vessels in the world which is about 400 metres long and could carry up to 20,000 containers.

The port is also expected to be connected to an $800m railway which is expected to be built to evacuate containers from the port.

It was gathered that private funders will bankroll the railway project while the seaport will eventually be handed back to the Federal government for ownership after the private developers have exhausted their rights to the place. This would increase the revenue base of Nigeria and Lagos. The facility was constructed by the Tolarams Group.

Checks showed that banks are only paying out N5,000 per withdrawal against the N20,000 announced by the Central Bank of Nigeria(CBN).


An official at the Polaris Bank, who pleaded anonymity, said the payment of N5000 was to ensure the available cash get to many customers.


There were no cash at several ATM points visited in Akure.

When I was 14, I liked a boy a lot because of his character, and good behavior and I respect him a lot. He is my senior. While having a conversation with him once he funnily said “ sunaina, if you reduce your weight a bit you will look more gorgeous”. But I took it seriously, without thinking about what is right or wrong I blindly fixed to lose weight for him and I don't know ways to how to lose weight except avoiding food.

I can somehow manage eating food when I was outside but what about at home? When my mother cooked chapati, bread, or whatever food for me without knowing to my parents I used to roll and hide that food in paper and while going to school I used to throw it on the roadside dustbin and this continued for 1 month.


One day my mother prepare lunch for me and kept it in a box to take to school. I thought if food is present with me I will somehow tempt to eat so what I did while leaving my home I went to my apartment cellar and threw the food in Dustbin, watchmen observed this and said to my parents.

In the evening, when I came home from school I somehow came to know that my parents got to know about food matter. My mother said, “If you didn't like the food you should have to tell me so that I will cook the food that you like and unnecessary don't waste the food”. My father made fun of what I did but never questioned me.

These situations made me realize how much my parents are understanding me, loving me, caring for me and I've decided not to do such stupid things because someone else and understands how much parents are working hard for their children and I should not misuse this freedom. I regret myself and from then I stopped throwing food and I came to know the value of food

From this incident, I learned

I might like a person but that doesn't mean to follow blindly whatever he said and I came to know what is right and wrong and never misuse the freedom given by my parents and don't let them down because of my stupid things.

The Central Bank of Nigeria (CBN) has reiterated some operations that mobile banking agents are not allowed to offer, as their population increases across the country.

In an Exposure Draft of the Regulatory Framework for Agent Banking in Nigeria, the CBN said mobile agents are barred from using merchants’ Point of Sale (PoS) terminals in the course of their operation.

According to the central bank, agents should avoid using the wrong option for transactions such as the use of the purchase option on PoS Terminals for cash-in and cash-out transactions.

Also, the financial regulator restricted the PoS agents from performing foreign currency transactions, opening accounts or disbursing loans to their customers.

“An agent shall not accept deposit or allow withdrawal above an amount which shall be prescribed, from time to time by the bank.

“Use the wrong option for transactions e.g agents shall not use the purchase option PoS Terminals for cash in and cash out transactions,” the circular signed by Musa I. Jimoh, Director, Payments System Management Department reads.

Also listed among services mobile banking agents are barred from offering are “Open accounts, grant loans or carry out any appraisal function for purposes of opening an account or granting of a loan or any other facility except as may be permitted by any other written law to which the agent is subject.
“Undertake cheque deposit and encashment of cheques. Accept deposit or allow withdrawal above an amount which shall be prescribed, from time to time, by the bank.


“The agent bank employee also should not be a staff of financial institution and also provide cash advances,” the central bank stated.

The CBN adopted the use of PoS agents to move banking closer to underserved areas across Nigeria and deepen financial inclusion.


PoS agents have saturated the country, with many Nigerians now patronising them for cash withdrawals, cash transfers and certain bill payments, instead of visiting commercial banks.

This prompted the need to reiterate the activities of the mobile banking agents, “This has necessitated the review of agent banking regulations to streamline activities in agent banking while ensuring that appropriate risk mitigation measures are taken by stakeholders”, it said.

The virus that causes COVID-19 most likely leaked from a Chinese laboratory, according to a classified US report based on new intelligence and recently sent to the White House and key members of Congress.

The stunning revelation by the US Energy Department comes more than a year after the FBI concluded a lab accident in China was the origin of the disease, which has killed more than 6.8 million people around the world, including 1.1 million in the US.

The FBI’s decision was made with “moderate confidence” and remains the bureau’s opinion, said The Wall Street Journal, which first reported the Energy Department’s own finding on Sunday, February 26.

But the judgment is considered important because the Energy Department which oversees the American nuclear weapons program runs a network of national labs and has a great deal of scientific expertise, the Journal said.

Both agencies (Energy department and FBI) arrived at their conclusions for different reasons, with the sources declining to detail the new intelligence cited by the Energy Department.

In response to the Journal’s report, White House National Security Adviser Jake Sullivan said, “There is a variety of views in the intelligence community” and that the origin of COVID-19 remained under investigation.

“Here’s what I can tell you: President Biden has directed, repeatedly, every element of our intelligence community to put effort and resources behind getting to the bottom of this question,” Sullivan told CNN’s “State of the Union.”

“And if we gain any further insight or information, we will share it with Congress, and we will share it with the American people. But right now, there is not a definitive answer that has emerged from the intelligence community on this question.”

The report is reportedly less than five pages long, and it’s unclear whether an unclassified version will be made public.

Last year, US Senate Republicans released an interim report that found the virus most likely leaked out of a Chinese lab and that ” the hypothesis of a natural zoonotic origin no longer deserves the benefit of the doubt or the presumption of accuracy.”

Mahmood Yakubu, chairman of the Independent National Electoral Commission (INEC), says accreditation figures and results will now be transmitted simultaneously on election day.

Speaking to journalists after monitoring mock accreditations in some polling units in Abuja, on Saturday, Yakubu said such simultaneous transmission would ensure the figures correlate.

He said although the commission would not comment on the court judgement of the Osun governorship election because it amounts to subjudice, it has learnt some lessons.

“However, in every situation, the commission learns, carries the experience from what has happened to improve the processes for the next election,” the INEC chairman said.

“We have learned some lessons from what happened and one of the lessons is to be able to transmit the accreditation data.”

He said INEC created a new uniform resource locator (URL) on its results viewing portal where both the accreditation figure and results could be viewed.

“We are going to transmit both the accreditation figures and the results on election day,” he said. “We are giving assurance to Nigerians that on election day, both the accredited data and the actual votes cast will be transmitted simultaneously and accurately.”

“We have also made contingency arrangements like we will do on election day, that there is a spare machine in case and in the unlikely event of a malfunction, we will be able to respond and fix the machines.”

Two persons were burnt to death in an attack on the campaign office of a House of Representatives candidate of the New Nigeria Peoples Party (NNPP) in Kano State.

The incident occurred on Sunday, Feb. 26, hours after the general elections. Confirming the incident in a statement on Monday, Feb. 27, the Police Public Relations Officer, PPRO, SP Abdullahi Kiyawa, said that a group of suspected thugs set the office ablaze with two unidentified persons in a stationary vehicle inside the building burnt to death.

The Kano State Police Command said it received reports of the incident around 4 pm during the collation of results at the INEC office in Tudun Wada Local Government Area.

According to Kiyawa, the hoodlums also mobilised and attempted to block the road leading to the INEC office.

“Security personnel were immediately mobilised to the scene,” the PPRO said.

“One of the thugs was fatally injured and was rushed to Hospital where he died while receiving treatment. Noting that an investigation is in progress, he added that “four other suspected thugs were arrested.”

In a similar incident, on Sunday around 2:30 pm., police foiled an attempt to burn down the INEC office in Takai LGA as election results were being collated.

Kiyawa also noted that the police and other security agencies, in a swift response, prevented the attack, and four suspected thugs were arrested.

“The collation of the results was concluded peacefully and an investigation is in progress,” he said.

DATE: TUESDAY MARCH 7TH 2023

THEME: THE STORM STILLER

MEMORISE: And he arose, and rebuked the wind, and said unto the sea, Peace, be still. And the wind ceased, and there was a great calm. Mark 4:39

READ: Mark 4:35 -41

35 And the same day, when the even was come, he saith unto them, Let us pass over unto the other side.

36 And when they had sent away the multitude, they took him even as he was in the ship. And there were also with him other little ships.

37 And there arose a great storm of wind, and the waves beat into the ship, so that it was now full.

38 And he was in the hinder part of the ship, asleep on a pillow: and they awake him, and say unto him, Master, carest thou not that we perish?

39 And he arose, and rebuked the wind, and said unto the sea, Peace, be still. And the wind ceased, and there was a great calm.

40 And he said unto them, Why are ye so fearful? how is it that ye have no faith?

41 And they feared exceedingly, and said one to another, What manner of man is this, that even the wind and the sea obey him?

MESSAGE

A storm is a problem so big and weighty that no one can single-handedly resolve it. However, storms can be stilled, and from my study of the Scriptures, such an occurrence is the result of the collaboration between God and man.

When a storm was brewing at the wedding in Cana of Galilee, there was a need for the servants to collaborate with Jesus in order to still it (John 2:1-10). If they had argued about pouring water inside a pot and taking a cup of it to the Chairman of the wedding, the storm would not have been stilled.

When the prophet's widow in 2 Kings 4:1-7 was hit with a storm that would have taken away her sons, she was told to borrow many empty vessels into which she was to pour her little oil. That instruction did not make any sense but she did her part by obeying and God did His by multiplying the oil. If you can collaborate with God, He can help you still any storm.

Some years ago while preparing for a programme in the North, l was told how the sandstorms there could get so bad that there would be no visibility at all. I said, "l See". That evening, while holding the programme outside as the crowd was too much for the little Church, a sandstorm suddenly started and people began to panic. I heard my father say to me, "Stretch your hand and say, "Peace". I did just that and immediately, the wind stooped, the sand fell back to the ground and we had a wonderful programme. In Mark 4:35-41, the Lord and His disciples were travelling in a boat when a storm arose. The Lord got up and stilled the storm, but then asked, "Why are ye so fearful? how is it that ye have no faith?"

Is there a storm in your life that has threatened you for long? The question for you is, "How is it that you have no faith?" Don't you know that, if you would only collaborate with God, you would still that storm? Go to God in prayer and stay in His presence until He tells you what to do to still that storm. A man or woman of God should not be frightened by a storm. He or she should simply speak peace to the storm in the name of Jesus and it would become still.

PRAYER POINT

Father, please tell me what to do to still the storm (mention the storm) in my life and family, in Jesus name.

The Federal High Court sitting in Lagos has restrained the Independent National Electoral Commission (INEC) from engaging Musiliu Akinsanya aka MC Oluomo-led Lagos State Parks Management Committee or any of its commercial bus drivers from distributing 2023 election materials and personnel in Lagos State.

The court granted the order of interlocutory injunction filed by the Labour Party (LP) and five others.

The order stands pending the hearing and determination of the substantive suit.

The court ruled that the order restrains the INEC (defendant/respondent) “whether by itself or by its officers, affiliates, servants, privies or agents or any person acting or purporting to act for and on its behalf howsoever from taking any steps or further steps whatsoever in furtherance of the engagement or appointment or consummating the appointment” of the Akinsanya-led Lagos State Parks Management Committee.

Residents of Bariga, Shomolu area of Lagos, were stranded on Sunday as Justrite, a popular supermarket, refused to collect both the old and new naira notes.

The supermarket said it was only accepting payment through the Automated Teller Machine (ATM) card and app transfers.

Asked why the shopping mall was not accepting both the old and new naira notes, a security guard at the entrance said, “It is the law. It’s just for a period of time.”

“We are not collecting cash. Transfer and your card.”

Residents, not happy with the rejection, were left stranded as some of them did not operate fund transfer via the ATM card or mobile banking app.


“They don’t want old or new notes. They are accepting cards,” one of the customers said.

“We that brought new notes cannot buy anything with it. It’s really frustrating. I can’t make any fund transfer,” a man, with a daughter outside the store, said.

“They are not collecting cash again. New notes, they no collect; old notes, they no collect. ATM, transfer, enter,” said another customer
