A 6-year-old American Indian girl had to wait one more day to find out whether her custody case will be transferred immediately to the tribal court of the Potawatami Indians. Cook County Juvenile Court Judge Claude E. Whitaker ruled two weeks ago that the case of Eleanor Armell should be turned over to the tribal court, but Patrick Murphy, the county public guardian, asked the judge to hold off on the order pending an appeal. On Tuesday, Whitaker delayed his ruling until Wednesday. Eleanor, who is half Potawatami and half Winnebago, has been living with a foster family since 1985, when she was found abandoned in an Uptown alley. Under a 1978 federal law, child-custody cases involving American Indians must be heard by tribal courts unless a parent objects.
