I agree with you if you don't have an extended cab, you'd have to exit the vehicle. That's the way I used to go to the range many years ago.
What more could they possibly expect?
Hmmmm....don't confuse logic with the law (as I was told by a lawyer). Where there is ill will, they may expect the impossible <sigh>

Does anyone have any updates on this specific case? With SB184 passing, it should make this entire case moot, since the debate over glove box vs storage box is now a nonissue- both can be unlocked.

Thanks in advance for any info!

We have not heard from Smithy in some time. I'm guessing his lawyer said "ixnay on the orumfey."

I do hope he pays a visit once things are settled.

As for Sean Culley, you're preaching to the choir. He's a regular contributor on this forum.

Hey Smitty! Good to know you're still around. We hope things are going well for you. We thought about you when HB184 passed carifying the console issue. Take care.

Page 2-43
Instrument Panel Storage Area
Your vehicle has a storage compartment on the instrument panel above the air vents. Push the button on the compartment to open the lid.
Item F on page 3-4
F. Storage Bin. See Instrument Panel Storage Area on page 2-43.
Bin means: A container or enclosed space for storage.

The question is whether a compartment in the dash is a "box' or "other container." The ORC does not define the terms "box" or "other container." Consequently, common usage is appropriate. ORC §1.42 provides, "Words and phrases shall be read in context and construed according to the rules of grammar and common usage."
One of the common definitions of the term "box" is defined in Webster's New World Dictionary is, "a boxlike thing, opening, or compartment." Thus, when opening the compartment in the dash, you are opening a "box".
Webster's New World Dictionary also defines the term "container" as, "a thing that contains or can contain something; box, crate, can, jar, etc." Thus, when you open a "box" (compartment in the dash), you also opened an "other container." Even if you label a "compartment in the dash," i.e. "box" or "container" as a "glove compartment," the distinction has no real legal significance. The United States Supreme Court in New York v. Belton, 453 U.S. 454 at footnote 4 noted, "'Container' here denotes any object capable of holding another object. It thus includes closed or open glove compartments, consoles, or other receptacles located anywhere within the passenger compartment, as well as luggage, boxes, bags, clothing, and the like." The "compartment in the dash" is, according to the Supreme Court of the United States, a "container."

IMO.

I have it on good word that the gun charge has been dismissed.

I'm sure smith149 will fill us in once the fat lady sings.

Though the gun charge has been dismissed the fat lady still has to sing.

The gun charge has been dismissed. Now ORC 9.68(B) will be addressed.

I've been following this post for a while and I guess it has been resolved for smith149 but now I'm worried about how each individual LEO may interpret "closed case, compartment or container" as I generally keep my handgun in the center console between the seats. It does not have a lock but it does have a latch that has to be pressed to open it. Should I be carrying a printed copy of the law to show an LEO? I worry that may be interpreted as me telling the LEO how to do their job!
I thought it was plain and simple but smith149 has me wondering
p.s. I won't be trying it out in Medina anytime soon!
