Major Articles Opposing the federal Hawaiian Government Reorganization bill (Akaka bill) and the creation of a state-recognized tribe under Hawaii Act 195 (Session laws of 2011) -- INDEX for years 2000 - 2014

The Akaka bill was first introduced into Congress in July 2000. For about 4 years the bill's sponsors pursued a stealth strategy and there were not very many major articles in opposition. But during 2005 and 2006 the bill became highly controversial. In Summer 2005 the bill was expected to come to the floor of the Senate for a vote, so there were many major publications opposing the Akaka bill in high-profile newspapers and magazines nationwide. But Hurricane Katrina blew away the Akaka bill until the following year. In 2006 the bill actually was debated on the floor of the Senate for four and a half hours on June 6 and 7, leading up to the bill's failure on a cloture motion. There were many major publications surrounding that floor debate; plus transcripts of the speeches on the Senate floor taken from the Congressional Record. On January 17, 2007 the bill was once again introduced, and immediately attracted major opposition which continued throughout 2007 and 2008.

In 2009 - 2010 we were faced with a President Obama who made a speech on the Senate floor in June 2006 supporting the Akaka bill, and who said during his Presidential campaign in 2008 that he will sign the bill. We remember that in 2007 every Democrat in the House voted in favor of the Akaka bill when it passed the House, and in 2006 every Democrat in the Senate voted in favor of the cloture motion to bring the bill to the floor. In 2009 - 2010 there was an even larger Democrat majority in both the House and Senate. The bill passed the House in February 2010, but was never placed on the calendar for possible floor action in the Senate.

In 2011-2012 things were much quieter in the 112th Congress, partly because the elections of November 2010 produced a massive shift to Republican control of the House; so the Akaka bill never got a hearing in the House Committee on Natural Resources. In the Senate the bill easily passed the Committee on Indian Affairs early in 2011 but remained dormant. Then a brand new version of it on steroids passed the same committee in September 2012. The new bill is very unlikely to come to the floor of the Senate due to short time and the fiscal cliff; and if it did get to the floor it would surely be filibustered by Republicans who have 6 more members than in the previous Congress. But the new bill will be the legacy left by retiring Senator Akaka and will likely be introduced by his successor in 2013. A stealth attempt by Senator Inouye toward the end of 2011 to insert a sentence into a budget bill to place the Akaka tribe onto the list of federally recognized tribes was defeated by vigilant Republicans in the House who stripped Senator Inouye's sentence out of the budget bill during its trip to the conference committee. Lack of Congressional activity resulted in no major publications in national media opposing the Akaka bill. However there was major activity in the Hawaii legislature during 2011 which began a process to create a state-recognized Akaka tribe; thus there were a few major publications in local Hawaii online media.

This webpage is an index providing a list of authors, article titles, dates, and the newspapers or magazines where major articles opposing the Akaka bill were published, from 2000 to now. The list is broken into segments in chronological order. Each segment of the index provides a link to a (sub)webpage containing full text of nearly all the articles, and links to the original sources of all of them.

"A Bright Line on Race" editorial in THE WALL STREET JOURNAL of October 2, 2000

Commentary in THE NATIONAL REVIEW, September 6, 2001, by Roger Clegg, Vice President and General Counsel of the Center for Equal Opportunity. A former Deputy Assistant Attorney General in the Reagan and Bush administrations, Clegg held the second highest positions in both the Civil Rights Division (1987-91) and in the Environment and Natural Resources Division (1991-93). Another article he wrote opposing the bill was published on January 7, 2004 (see below, in chronological order).

"Hawaiian Apartheid" was published in many venues by nationally syndicated conservative writer Michelle Malkin. Below is that article as it appeared in the July 27, 2001 edition of the JEWISH WORLD REVIEW:

"Hawaiian Sovereighty: 3 Alternatives, No Choice" by Kenneth R. Conklin, Ph.D., The Honolulu Advertiser, July 20, 2001

"Akaka Bill unlikely to survive challenge" by Honolulu attorney Paul M. Sullivan, The Honolulu Advertiser, June 11, 2001

"A Race to Racism? Ascribe It To Tribe" by Honolulu attorney Paul M. Sullivan, published in "Hawaii Reporter on March 21, 2003 and also published in the March 2003 issue of "In Pursuit" -- the newsletter of the Grassroot Institute of Hawaii.

"Activists must not dictate state's future." by Ken Conklin. Published in The Honolulu Sunday Advertiser, August 10, 2003. Both independence and the Akaka bill are bad ideas. The best option is unity under a single sovereignty, equality under the law, and aloha for all. Propaganda falsehoods are corrected.

An article by nationally syndicated columnist Thomas Sowell regarding reparations for slavery is directly relevant to the Hawaiian sovereignty debates. The questions he addresses include whether it is a good idea for a racial or ethnic group to demand political power based on historical grievances, and whether it is a good idea to establish a race-based government. The article is copied in full below, as taken from

"Bad Bill for Hawaii and All States" HUMAN EVENTS online, Jan 7, 2004 by Roger Clegg, Vice President and General Counsel of the Center for Equal Opportunity. A former Deputy Assistant Attorney General in the Reagan and Bush administrations, Clegg held the second highest positions in both the Civil Rights Division (1987-91) and in the Environment and Natural Resources Division (1991-93). This article was sent to the Attorney General, the Secretary of Interior, and to all members of the U.S. House of Representatives Committee on Resources on March 4, 2004 with a cover letter from Linda Chavez, President of the Center for Equal Opportunity. In 2000, Chavez was honored by the Library of Congress as a "Living Legend" for her contributions to America's cultural and historical legacy. In January 2001, Chavez was President George W. Bush's nominee for Secretary of Labor. Chavez previously served as Staff Director of the U.S. Commission on Civil Rights (1983-1985); and in 1992 she was elected by the United Nations' Human Rights Commission to serve a four-year term as U.S. Expert to the U.N. Sub-commission on the Prevention of Discrimination and Protection of Minorities. The article is copied in full below. In addition, it can be downloaded in its original format as a pdf file at:

Richard Engle is the President of the National Federation of Republican Assemblies. On January 29, 2004 he circulated a parody of support for the Akaka bill. He says he will support the bill if it is amended to add recognition for his own highly persecuted and under-privileged tribe of Native Slavo-Gaelics.

In October and November, 2004 the nationally circulated Washington D.C. newspaper "The Washington Times" published a series of three articles about the Hawaiian recognition bill. One of the articles was by constitutional law expert Bruce Fein, and another article was by attorneys representing the Office of Hawaiian Affairs. The full text of all three articles can be found at:

Earl Arakaki is lead plaintiff in Arakaki v. Lingle lawsuit to abolish government agencies of the State of Hawai'i that provide racially exclusionary benefits to ethnic Hawaiians; namely, the Office of Hawaiian Affairs and the Department of Hawaiian Homelands. From December 17, 2004 through January 19, 2005 a series of four articles were published in Hawaii Reporter on-line newspaper. This series is notable because the second article was by the Attorney General of the State of Hawai'i, Mark J. Bennett, claiming that the Akaka bill would be constitutional and would be a good thing to do. The third and fourth articles were direct replies to his claims. All four articles are gathered together at:

On March 13, 2005 An article was published in Hawaii Reporter (on-line) saying that the Akaka bill is intentionally vague about the impacts the bill would have on local businesses and communities in Hawai'i. The article describes some of the actual consequences of federal tribal recognitions on the mainland, focusing on Washington state. The author is Elaine Willman, Chair of the Citizens Equal Rights Alliance (CERA) in Toppenish, WA. The full text of her article is copied below on this webpage.

Jerry Coffee (Captain, U.S. Navy, Retired) was the pilot of a reconnaissance aircraft flying over North Vietnam when shot down in 1966. He was held as a prisoner of war until released in 1973. An article was published by Jerry Coffee as his weekly column in the March 16, 2005 issue of "Midweek" newspaper in Honolulu. That article, "Arguing Against the Akaka Bill," is copied in full, below, in chronological order.

Attorney Bruce Fein, nationally recognized expert on Constitutional law, published three articles opposing the Akaka bill, between November 2004 and March 2005. The articles were entitled "The Pineapple Time Bomb"; "A Race-based Drift?"; and "E Pluribus Unum, Debating the Legality of the Akaka Bill." All three articles were entered into the Congressional Record by Senator Kyl (R. AZ) on March 17, 2005, along with Senator Kyl's own statement reaffirming his opposition to the Akaka bill. The actual pages of the Congressional Record can be seen, along with URLs for the original sources of the three articles and some closely related articles. Go to:
https://www.angelfire.com/hi2/hawaiiansovereignty/AkakaFeinCongRec031705.html

In March 2005 the Honolulu Star-Bulletin conducted an on-line poll which asked the question "Would you like to see the Akaka bill become law?" When the poll ended, the votes were "Yes" 436 and "No" 1301 -- a resounding 75% opposed. This in the only time public opinion on the Akaka bill has ever been gathered in a survey open to anyone who cared to participate. That is important, because the State of Hawai'i does not allow citizens to place "initiative" questions on the ballot; and even Constitutional amendments must first be approved by the Legislature before being placed on the ballot. Previous Akaka-bill polls were conducted under circumstances controlled by supporters of the bill. See:
https://www.angelfire.com/hi2/hawaiiansovereignty/AkakaSBpollmarch2005.html

Paul M. Weyrich is the Chairman and CEO of the Free Congress Foundation. On June 13, 2005 he published an article in "The Austin Review" entitled "Native Hawaiian" Government -- A Dangerous Experiment. The article is copied in full below. Its citation is:

On June 14, 2005 an article "The Akaka Bill Could Give Birth to the Nation of Aztlan" was published by Don Newman, Senior Policy Analyst for the Grassroot Institute of Hawai'i, in Hawaii Reporter (on-line) at
http://www.hawaiireporter.com/story.aspx?f0c797b0-6025-4a3f-8a11-7541cae9db52

The analysis of the Akaka bill as related to MEChA (Nation of Aztlan) presented in the above short article was limited by space, but its analysis is similar to an article previously published in Hawaii Reporter on September 3, 2003 by Kenneth R. Conklin: "Hawaiian Nationalism, Chicano Nationalism, Black Nationalism, Indian Tribes, and Reparations - Akaka Bill Sets a Precedent for Balkanizing and Dismembering America"
https://www.angelfire.com/hi2/hawaiiansovereignty/AkakaHawnChicanoNatnlHawRept.html
. That article in turn was based on a webpage twice as long by the same title with much greater detail:
https://www.angelfire.com/hi2/hawaiiansovereignty/AkakaHawnChicanoNatnl.html

SUMMARY

There are strong similarities between the Hawaiian sovereignty movement and the Chicano nationalist movement. The 2003 Gubernatorial recall campaign in California focused public attention for a few days in August on the radical agenda of an ethnic nationalist group to which Lieutenant Governor Cruz Bustamante belongs. This Chicano-power group is MEChA, or Nation of Aztlan. Its view of history and demands for nationhood are strikingly similar to the Hawaiian sovereignty movement.

A bill now being considered in Congress, S.147 and H.R.309 (the Hawaiian Government Reorganization bill), would give federal political recognition to an ethnic group in Hawai'i as though they are an Indian tribe. This bill is pork barrel politics, designed to protect 160 racially exclusionary government programs for "Native Hawaiians" which will otherwise be ruled unconstitutional by the courts. But the same misguided theory that would allow Congress to convert an ethnic group into a racial separatist government in Hawai'i could also be used to support racial separatism and eventual independence for "indigenous" people of Mexican ancestry in California, Arizona, New Mexico, Texas, and perhaps other states. Anyone concerned about MEChA, Nation of Aztlan, or Chicano nationalism should also be concerned about Hawaiian nationalism, and vice versa. The success of one would help the other both politically and legally. There are also parallels to Black nationalism and demands for reparations for slavery.

What makes Hawaiian nationalism of special concern to the rest of America is that it may be the first nationalist movement to succeed in establishing a government, thanks to the support of Hawai'i's powerful senior Senator, Daniel Inouye. S.147/H.R.309, the Native Hawaiian Recognition bill, would give a political and legal victory to Hawaiian nationalism, setting a precedent for other ethnic nationalist movements. Our country is strong enough militarily to defeat any foreign enemy. Our most dangerous enemy comes from within -- the idea of race-based rights and ethnic nationalism. S.147/H.R.309 is the thin edge of a very large knife poised to dismember America. That is a very good reason why Senators and members of Congress from throughout America must oppose this disastrous legislation.

Constitutional law expert Bruce Fein published a booklet June 1, 2005 under the auspices of the Grassroot Institute of Hawaii: "Hawaii Divided Against Itself Cannot Stand." Mr. Fein's essay is of special interest to scholars because of his analysis of the apology resolution of 1993 as well as the provisions of the Akaka bill. It can be downloaded in pdf format here:
https://www.angelfire.com/hi5/bigfiles3/AkakaHawaiiDividedFeinJune2005.pdf
Senator Kyl (R, AZ) obtained unanimous consent to print Mr. Fein's essay in the Congressional Record in three installments on three consecutive days: June 14, 15, and 16 of 2005. Each installment was introduced by brief remarks by Senator Kyl. The relevant portions of the Congressional Record are copied here:

On June 22, 2005 the U.S. Senate Republican Policy Committee issued a 13-page report on the Akaka bill entitled: "S.147 Offends Basic American Values -- Why Congress Must Reject Race-Based Government for Native Hawaiians." The report, on official stationery, can be downloaded in pdf format here:

On July 5, 2005 the Grassroot Institute of Hawai'i released the report of a scientific survey of Hawai'i's people done by an out-of-state professional survey company. The survey showed that out of 10,000 people who were called on the telephone, 67% of those who responded to the question said they are opposed to the Akaka bill. Furthermore, 45% feel strongly enough about this issue that they are less likely to vote for any politician who supports the bill. The results of this survey are posted, along with a review of other surveys previously conducted, at
https://www.angelfire.com/hi5/bigfiles3/AkakaScientificSurvey070505.html

ON JULY 18, 2005 "THE NATIONAL REVIEW" PUBLISHED AN ARTICLE BY RAMESH PONNURU ENTITLED: "A RACE-BASED STATE -- HAWAII WANTS A SEGREGATION THAT WOULD BOGGLE YOUR MIND". That article is copied in full at the bottom of this webpage (in chronological order).

Huge Poll Shows Strong Opposition to Akaka Bill

By Andrew Walden

An audacious polling effort, calling every single household in Hawaii, and gaining responses from 39,000 of the total 280,000 households, shows strong opposition to passage of the Akaka Bill S147/HR 309.

The poll was commissioned by the Grassroot Institute of Hawaii. Polling was conducted by FEC Research between June 29 and July 10. When asked, "Do you want Congress to approve the Akaka Bill?" only 28.2 percent of registered voters answered "yes," 56.8 percent said "no," and 15.0 percent did not answer. Counting noes over only those who responded to the question, 66.8 percent oppose the passage of the Akaka Bill.

On July 19, 2005 the House of Representatives, Committee on the Judiciary, Subcommittee on the Constitution, held a hearing regarding the issue whether the Akaka bill is unconstitutional. Some of the testimony presented at that hearing is available at:

It is very unusual for a Senator to participate in a subcommittee hearing in the House of Representatives. But Senator Kyl (R, AZ) feels so strongly opposed to the Akaka bill that he submitted a 14-page statement regarding that bill's unconstitutionality. The statement, on official stationery, can be downloaded in pdf format from:

E Pluribus Unum? Not in Hawaii.

By SLADE GORTON and HANK BROWN

These two former Senators, from Washington and Colorado, led the fight against the Apology Resolution of 1993. In this article they point out that the Apology Resolution is now cited three times in the Akaka bill as a justification for creating a race-based government and race-based communal money and land; despite the fact that Senator Inouye had assured them on the Senate floor that the resolution would never be used that way. ** Full text below, in chronological order.

June 5, 2006: John Fund (Wall Street Journal) asks "Will the Senate impose race-based government on Hawaii?" He concludes "But the Akaka bill is not just another special-interest boondoggle. Text of Senator Akaka's speech at the time of introducing the Akaka bill on January 17, 2007 INTERSPERSED WITH COLOR-CODED CORRECTIONS AND COMMENTS by Jere Krischel and Ken Conklin

Press release and floor speech by U.S. Senator Lamar Alexander (R, TN) opposing the Akaka bill, on January 17, 2007 (same day the bill was introduced)

Peter Kirsanow, Commissioner, U.S. Commission on Civil Rights, published a lengthy commentary opposing the Akaka bill in National Review on January 18, 2007, entitled "Disunited States; Multiculturalism Run Amok." First sentence: "The worst piece of legislation ever analyzed by the U.S. Commission on Civil Rights has been brought back from the dead and may be enacted in the next few weeks."

Essay by Ken Conklin: "Akaka Warns: The Natives Are Restless (Schoolyard Bully Wants Your Lunch Money)." Senator Akaka introduced his bill for 2007 with a speech on the Senate floor that included a warning that there will be racial trouble unless the Akaka bill is passed. This is intimidation; demanding appeasement.

February 27: Article in Hawaii Reporter analyzes an advertisement by OHA in Honolulu Advertiser whose purpose was to persuade everyone that "Hawaiian" properly refers to a racial group rather than to citizens of Hawai'i. "This is what the Akaka bill and OHA are asking for. They ask you to be ignorant of the multi-ethnic history of the Kingdom of Hawaii. They ask you to take an internationally recognized nation, which established equal rights over 100 years before our own civil rights movement, and to undo their progressive political acts." George F. Will, nationally syndicated columnist, published a major commentary ripping the Akaka bill in The Washington Post and reprinted in numerous newspapers throughout America.
"Social Engineers In Paradise"
By George F. Will
The Washington Post, Thursday, November 29, 2007, Page A25
http://www.washingtonpost.com/wp-dyn/content/article/2007/11/28/AR2007112802053.html
The commentary drew a large number of comments on the newspaper's blog for this article. The comments make interesting reading to see how some angry Hawaiian sovereignty zealots trash George Will and try to defend the Akaka bill, while many opponents of the Akaka bill come forward to say he told the truth. See:

In view of George Will's comments comparing the Akaka bill's racism with the racism of Hitler's treatment of Jews, and in view of comments saying that comparison is absurd, it is notable that one of the many places where George Will's article was reprinted was the Jewish World Review, whose audience knows the comparison is appropriate.

10th Anniversary of U.S. Supreme Court Decision in Rice v. Cayetano
The February 23, 2000 U.S. Supreme Court decision spurred a decade of additional civil rights lawsuits seeking to abolish or desegregate Hawaii's empire of government and private race-based programs. Racial separatists immediately sought protection for those programs through the Hawaiian Government Reorganization bill (Akaka bill) still being pushed in Congress 10 years later.

September 16, 2013: 4 of the 8 members of the U.S. Commission on Civil Rights jointly wrote a strongly-worded 5-page letter to President Obama opposing any attempt to use executive action to give federal recognition to an Akaka tribe. The letter reiterated reasons for opposing the concept of the Akaka bill, expressed in several official statements by USCCR in previous years, and added objections to the new concept of using executive authority to do what Congress has refused to do for 13 years. The USCCR letter, dated September 16, 2013 on official letterhead and bearing the signatures of the 4 Commissioners, can be seen at

Dr. Akina explains that OHA trustees, and their CEO, are officers of the State of Hawaii and must be held accountable for challenging the sovereignty of the United States in Hawaii and for requiring enrollees on the Kana'iolowalu racial registry to affirm "the unrelinquished sovereignty of the Native Hawaiian people." "Native Hawaiians Are Not A Tribe" and making them a tribe would ensure the death of aloha.

August 1, 2014 four U.S. Senators sent a letter to Sally Jewell, Secretary of the Department of Interior, protesting the Advance Notice of Proposed Rulemaking where by DOI intends to create a Hawaiian tribe and give it federal recognition. Senators Lamar Alexander, Tom Coburn, Jeff Flake, and Mike Lee said "The action proposed in the ANPRM is at worst unconstitutional, and at best offensive to the character of a country devoted to the advancement of all its citizens regardless of race." The letter cites the repeated refusal of Congress to pass the Akaka bill, the letter from four Commissioners of the U.S. Civil Rights Commission warning that recognition through rule-making would be both unconstitutional and bad public policy, and language from the Supreme Court decision in Rice v. Cayetano. The two-page letter on official stationery and bearing the signatures of the four Senators can be downloaded at

August 19, 2014: This was the final day to submit testimony regarding the Department of Interior Advance Notice of Proposed Rule-Making to create a Hawaiian tribe and give it federal recognition by an administrative procedure without Congressional action.

At least 2069 written comments were submitted. A large majority were opposed to the Department of Interior proposal. The following seven testimonies are especially valuable in opposition because they explicitly rely upon the fundamental principles of racial equality and the unity of all Hawaii's people under the undivided sovereignty of the State of Hawaii:
