Mandurah man Nathan Paul Smith fined over bikie tattoo

A member of prominent bikie gang has been dealt a hefty fine after being arrested in Mandurah with his club tattoo clearly on display.

Nathan Paul Smith faced Mandurah Magistrates Court via video link on May 6 charged with one count of displaying the insignia of an identified organisation in a public place.

The charge relates to the Criminal Law Bill 2021, which gives police the power to prevent bikies from gathering in public places and wearing their patches or displaying insignia, including club tattoos.

Prosecutor Sergeant Flint told the court that on February 4, 2021, Smith was arrested on Scott Street, Mandurah for an unrelated matter and during the arrest police noticed his right arm was uncovered, displaying the club tattoo.

Duty Lawyer Kasturi Murthy, who was representing Smith, said while he accepts he had the tattoo on display, it wasn’t at the forefront of his mind while walking home at night.

Magistrate Leanne Atkins then held up a photo of Smith’s tattoo and said “you mean this tattoo, that covers the entire length of his arm?”.

Ms Murthy said it was a silly mistake made by Smith and he didn’t want it to affect his plans of moving to Narrogin to live a quiet life after his release.

Smith is currently serving a prison sentence for a separate matter and could be released as early as February 2023.

Ms Atkins said she acknowledged Smith was already serving a prison sentence and a fine was as far as she was going to take matters.

Smith was fined $1000.
