EU adopts additional trade sanctions in response to situation in Ukraine

On February 24th, the European Union adopted additional sanctions in response to the Russian invasion of Ukraine. These sanctions build on, and expand on, earlier sanctions.
This 10th package includes the following elements:
  • Further extension of the list of restricted items which might contribute to Russia’s military and technological enhancement, or the development of its defence and security sector.
  • An extension of the list of restricted items which might contribute to the enhancement of Russia’s industrial capabilities.
  • An extension of the lists of items which generate significant revenues for Russia.
  • A prohibition on the transit of dual-use goods and firearms via the territory of Russia to third countries.
  • A prohibition on Russian nationals from serving on governing bodies of Member States' critical infrastructure companies.
EU sanctions regulations have direct effect in all Member States of the EU, and, as such, are legally binding on all natural and legal persons in Ireland. Private companies have an obligation to ensure that they are in full compliance with these new measures. A person who contravenes a provision of an EU sanctions regulation shall be guilty of an offence and liable to prosecution.
Other provisions are included on the full list of sanctions, which can be found on the Department of Enterprise, Trade and Employment webpage: https://tinyurl.com/y862hdwv

Changes made to the Temporary Business Energy Support Scheme (TBESS)

Minister for Finance, Michael McGrath T.D has announced changes to the Temporary Business Energy Support Scheme (TBESS). These changes provide for:
  • An extension of the scheme to 30 April 2023
  • An increase in the monthly limit on payments to €15,000 up from €10,000 (to take effect from 1 March 2023), with the €30,000 limit increased to €45,000 per qualifying businesses operating across multiple locations.
In addition, the Government has proposed further enhancements to the scheme, subject to State aid approval. These proposals include:
  • An extension of the scheme to May 31st, 2023
  • A reduction of the energy costs threshold from 50% to 30%, effective from September 1st, 2022
  • An increase in the Temporary Business Energy Payment (TBEP) amount from 40% to 50% of a business’ eligible costs
  • Extension of the time limit for all claims to July 31st, 2023.
Qualifying businesses can continue to make claims for the September 2022 to February 2023 claim periods. Revenue will advise businesses when they can make claims for the March 2023 claim period.

Government approves Annex of Actions to Climate Action Plan 2023

The Government has approved the Annex of Actions to the Climate Action Plan 2023, to address the climate crisis.
The Climate Action Plan 2023 sets outs how Ireland is putting climate solutions at the centre of our social and economic development, with the primary goal being that Ireland must meet legal obligations to reduce its emissions by 51% by 2030 and reach net zero by no later than 2050. The Climate Action Plan details actions across a number of areas, including six vital, high-impact sectors:
  • Powering renewables
  • Building better and sustainably
  • Transforming travel for all
  • Making family farms more sustainable
  • Changing Ireland’s land use
  • Making business and enterprises more green
