GENERAL COMMENTS
On 7/18/23 at 0900 hrs., I conducted an inspection of Dakota Oil & Gas Co.'s Kenneth D Mumau et ux 1 well (API 063-27569)
in Grant Twp., Indiana Co. in response to a reported production fluid release. On 7/13/23, the operator reported a release of
approximately 5 barrels of production fluid onto the ground, due to a mowing incident by the landowner. Excavation of the
release area was conducted on 7/14/23. Photos of the release area and initial excavation were provided to the Department via
email, and have been uploaded to eFacts. Impacted material is staged onsite on 20 mil plastic liner. The excavation area and
impacted soil were also covered with 20 mil liner. Soil conductivity screening of the excavation is to occur later today, 7/18/23,
and additional excavation will be conducted as needed.
The production fluid tank was emptied and removed from the site prior to inspection. The well is equipped for production. A well
tag is affixed to the well head. The operator has been reminded that a site ID sign with the operator’s name, address, phone
number, and well permit number should be re-posted once the brine tank is replaced.
Violations of 78.57(a), SWMA 610(1), SWMA 301, and SWMA 302(A) are cited for the release of production fluids from the
tank onto the ground. The violations will be resolved upon remediation of the site and attainment of an Act 2 standard. Please
refer to page 3 of this Notice of Violation regarding a written response describing how you intend to remediate the release and
demonstrate attainment of an Act 2 standard.
