Refer A Friend Cashback Rewards Terms and Conditions

1. The Refer a Friend cashback reward program is a weekly reward programme commencing on Monday 27^th April 2020, which allows you to get cashback when you refer a friend and they play on www.partypoker.com (“Refer a Friend Reward Plan”).
2. For the purposes of this Refer a Friend Reward Plan, a “week” shall mean Monday 00:00:00 (CET) to Sunday 23:59:59 (CET). The time zone shall be CEST between 29^th March and 27^th October 2020.
3. This Refer a Friend Reward Plan is not available to players: (1) who are resident in the United Kingdom; or (2) who are associated and/or have a commercial relationship with the Promoter, including but not limited to brand ambassadors, sponsored pros, streamers and team online members.
4. By taking part in this Refer a Friend Reward Plan, you hereby agree to these terms, the Standard Promotional Terms and Conditions and to our General Terms and Conditions.

Refer a Friend Cashback

5. To participate in this Refer a Friend Reward Plan, an existing real money player registered on www.partypoker.com (a “Referring Player”), must use the specific link assigned to the Referring Player (the “Unique Link”) as specified below.
6. The Referring Player must have an active account and use the Unique Link to invite Invited Player(s) (as defined below) to sign up for an account with www.partypoker.com.
7. An Invited Player must:
1. be over 18 years old;
2. not currently hold, or have previously held an account with www.partypoker.com;
3. arrive at www.partypoker.com via the Unique Link provided by the Referring Player;
4. not be self-excluded;
5. successfully register an account with www.partypoker.com and pass all KYC and verification checks applied from time to time as set out in our General Terms and Conditions; 
6. must live at a different address than that of the Referring Player and be using a different device; and
7. must have a different deposit account from that of the Referring Player.

Mechanics:

8. If an Invited Player satisfies the Requirements (as defined below) in any week of the Refer a Friend Reward Plan, we will credit the Referring Player on the next Monday with:
1. 10% cashback on the Total Rake (as defined below) generated by the Invited Player during those weeks between 27^th April and 24^th May 2020; and
2. 5% cashback on the Total Rake (as defined below) generated by the Invited Player during those weeks after 25^th May 2020.

9. In order for cashback to be payable to the Referring Player on a Monday, an Invited Player must have played on www.partypoker.com and have generated rake on poker games and/or a fee on poker tournaments in the previous week.

10. The Referring Player must;
1. only send the Unique Link to friends who: (i) are over the age of 18; and (ii) who they have an existing relationship with and who they reasonably believe would be interested in receiving the invite. The Referring Friend must not “spam” anyone with invites;
2. not invite any person who is registered in a territory which we do not accept players from;
3. not offer any incentives or rewards, or make any false or misleading statements, to encourage Invited Players to use www.partypoker.com;
4. use the Unique Link only for personal and non-commercial purposes and in good faith;
5. only use the channels provided on the Refer a Friend account page to share the Unique Link with Invited Players directly and must not share or post the Unique Link on any other public or social medium, including any medium that would have a particular appeal to anyone under the age of 18,
6. must not post or serve any other form of promotional or advertising material in respect of the Promoter or www.partypoker.com;
7. not allow or assist any third party to publish the Unique Link on their websites, social media or other marketing materials;
8. not use the Unique Link, the Promoter’s details or partypoker.com alongside or in connection with any inappropriate content (including, without limitation, any defamatory or libellous content, pornographic, obscene, offensive or other explicit content or anything that infringes a third party’s intellectual property);
9. not make any misleading claims about the Promoter or misrepresent your connection to the Promoter or partypoker.com;
10. not do anything that may harm or damage the brand, goodwill or reputation of the Promoter or www.partypoker.com;
11. not do anything to infringe the intellectual property rights of the Promotor or partypoker.com;
12. not directly or indirectly engage in any act that is in bad faith, fraudulent, involves collusion, abuse of promotions, violation of money laundering laws and regulations, false or misleading advertising, or is intended to manipulate us and/or this Refer a Friend Reward Plan;
13. have obtained and shall maintain any necessary registrations, authorisations, consents and licences that may be required to participate in the Refer a Friend Reward Plan;
14. not use the Refer a Friend Reward Plan in any way that breaches applicable local, national or international law or regulation, or in any way which is unlawful, fraudulent or wrongful; and
15. as the sender of the Unique Link, comply with any applicable laws including any advertising requirements that may apply.
11. The Total Rake shall mean: the total real money rake generated by the Invited Player on poker games on www.partypoker.com plus the total real money entry fees generated in tournaments on www.partypoker.com, in the relevant week.
12. Any rake generated from a cash poker game shall contribute to the Total Rake calculation on completion of the poker game. Any fee from a poker tournament shall contribute to the Total Rake calculation at the time the player is ranked, which may fall on a different day to when the tournament is played. If a player is ranked in the following week, the fee will count towards the Total Rake calculation of the following week.



For example, if a player enters a tournament that takes place on Sunday 10th May at 23:15 and is ranked on Monday 11^th May at 15:30, the fee will contribute to the Total Rake of the week commencing Monday 11^th May and will be reflected in the Referring Player’s cashback credited on Monday 18th May.

13. The Promoter reserves the right at any time to deduct any costs associated with providing services to the Invited Player from the Invited Player’s Total Rake before calculating a Referring Player’s cashback.
14. The cashback shall be credited to the Referring Player each Monday based on the Total Rake accumulated by the Invited Players in the previous week.
15. The cashback calculated from the Invited Player’s Total Rake must amount to a minimum of $0.01 (or equivalent currency) in the relevant week in order for the Referring Player to be credited with cashback.
16. The total cashback a Referring Player may be credited with shall be limited to:
1. A maximum of $500 (or equivalent currency) per week per Invited Player;
2. A maximum of $10,000 (or equivalent currency) per Invited Player over the course of the Refer a Friend Reward Plan;
3. A maximum of $2,500 (or equivalent currency) per week across all Invited Players; and
4. A maximum of $50,000 (or equivalent currency) across all Invited Players over the course of the Refer a Friend Reward Plan.
17. The Referring Player shall be responsible for any taxes, duties or other amounts that may be payable arising out of participation in the Refer a Friend Reward Plan.
18. If any Invited Player has not placed any real money stakes and not generated any real money rake or fee on www.partypoker.com for a period of 60 days, that Invited Player shall no longer be eligible to continue to participate in this Refer a Friend Reward Plan and the Referring Player shall no longer be entitled to any cashback in respect of the Invited Player. The Invited Player will not be able to re-enter the Refer a Friend Reward Plan.
19. If the Referring Player has not placed any real money stakes and not generated any real money rake or fee on www.partypoker.com for a period of 60 days, they shall be removed from the Refer a Friend Reward Plan and shall no longer be entitled to any cashback in respect of any existing Invited Players.
20. The Referring Player shall be able to re-enter the Refer a Friend Reward Plan once they become active again and place a real money stake. At this point the Referring Player will be able to use the Unique Link to invite new Invited Players and will be entitled to cashback if those new Invited Players meet the Requirements. The Referring Player shall not be entitled to receive cashback in respect of any of the old Invited Players from before the period of inactivity. 
21. If an Invited Player’s account is closed for any reason, they shall no longer be eligible to continue to participate in this Refer a Friend Reward Plan and the Referring Player shall no longer be entitled to any cashback in respect of that Invited Player. If a Referring Player’s account is closed for any reason, they shall no longer be eligible to participate and shall no longer be entitled to any cashback.
22. If any player is suspected to be guilty of fraudulent or other suspicious activity, and/or is deemed to be taking advantage of the Refer a Friend Reward Plan or any promotion, that player shall no longer be eligible to continue to participate in this Refer a Friend Reward Plan and no cashback shall be payable.

Use of data

23. The Invited Player agrees and acknowledges that their username, and information in respect of whether or not they have registered and deposited on www.partypoker.com, shall be visible to the Referring Player for a period of 14 days from the date they register their www.partypoker.com account.
24. The Invited Player’s transactional data shall be reviewed and used during the course of the Refer a Friend Reward Plan to calculate the Referring Player’s weekly cashback and to administrate the scheme. The amount of cashback generated by the Invited Player’s transactions shall be displayed to the Referring Player for a period of 3 months.
25. Personal data shall be processed in accordance with our privacy policy.

General

26. Any failure to follow the terms and conditions referred to herein and/or our Terms and Conditions of Use or Specific Promotional Terms and Conditions, any abuse of the Refer a Friend Reward Plan or any conduct detrimental to the interests of the Promoter or its affiliated companies may result in the termination of your membership of the Refer a Friend Reward Plan and the cancellation of any accrued cashback.
27. We reserve the right to modify, alter, discontinue or terminate the Refer a Friend Reward Plan (including without limitation: by changing the amount of the cashback and the way cashback is generated, earned, awarded, collected and/or redeemed).
28. We may amend these terms and conditions at any time either by emailing you a notification of the new terms and/or by publishing the modified terms and conditions on www.partypoker.com.
29. We also reserve the right to alter, discontinue or terminate the promotion in accordance with the terms of our Standard Promotional Terms and Conditions.
