A case before the South Dakota Supreme Court could have implications for all law enforcement officers in South Dakota.

Emily Lou Smith was arrested last year by Minnehaha County sheriff’s deputy Adam Zishka. Smith faces a long list of charges, including three counts of simple assault against a law enforcement officer.

Smith’s attorney argued to the high court that all disciplinary records against Deputy Zishka from the past five years should be released.

“Any statements in the use of force documents pertaining to the officer’s statement as to the level of force that he used, his version of the events and any investigation by supervisors as to whether those claims sustainability those certainly would be relevant,” defense lawyer Beau Blouin said.

The state’s attorney’s office says personnel records are not subject to open record laws.

“Additionally, administrative records in South Dakota that state employee records are confidential and the only exception in that is salary information and title for that employee maybe provided,” Minnehaha County deputy state’s attorney Sara Show said.

The high court will make a ruling at a later date. The Supreme Court is back in session tomorrow morning at nine at the USD law school in Vermillion.
