REQUEST FOR COUNCIL ACTION

ORDINANCE: O-2006-15

SUBJECT: Ordinance authorizing the exchange of City Park property for property of approximately equal size and value in the immediate area and rezoning of the property to be conveyed by the City from R1A (Residential One Acre) to PD (Planned Development).

ADDRESS: Approximately one half mile southwest of the intersection of Alameda Avenue and Bear Creek Boulevard in the east one half of Section 25, Township 4 South, Range 70 West of the 6th Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado.

RECOMMENDATION: Approve the ordinance.

FUNDING SOURCE: Like for like property exchange with appraisal costs borne by developer.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The City acquired the property known as Iron Springs Park in 1974 for "park and other municipal purposes only". The property has been used as open space and an off leash area for dogs.

In 1998, the City of Lakewood adopted the Rooney Valley Master Plan as an amendment to the Lakewood Comprehensive Plan. The plan showed an open space buffer between existing residential development and new developments in the valley as well as the potential exchange of a portion of Iron Spring Park in order to create the open space buffer.

The developer of the Springfield Green portion of Rooney Valley, Carma Lakewood, LLC, has requested that the City exchange approximately 21.764 acres of Iron Spring Park for approximately 21.771 acres of privately owned land located south of Alameda Parkway and west of Hutchinsons Green Mountain Village Filings 54, 55, 56 and 62. The proposed exchange would allow the property to be developed in accordance with the Rooney Valley Master Plan.

The property currently owned by the City is currently zoned R1A (Residential One Acre). In order for the developer to accept the trade, the property must be rezoned to PD (Planned Development) so that the zoning is consistent with the remainder of the Springfield Green development.

The land exchange and the rezoning are interdependent and therefore one ordinance has been drafted to accomplish both actions. The land exchange helps to implement the Rooney Valley Master Plan and the exchange will result in no net loss of value or parkland in the immediate area therefore it is consistent with the 1974 deeds.
