Synopsis: Hunting on rivers in an area of high population density.
Prohibits hunting for waterfowl on or along a river or stream in an area
with a high population density. Requires the county executive to
prepare and make available to the public a map that indicates areas
where waterfowl may not be hunted because of a high population
density. Requires the map to be revised at specified times.

HOUSE BILL No. 1194
A BILL FOR AN ACT to amend the Indiana Code concerning
natural and cultural resources.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 14-22-10-12 IS ADDED TO THE INDIANA
CODE AS A NEW SECTION TO READ AS FOLLOWS
[EFFECTIVE UPON PASSAGE]: Sec. 12. (a) For purposes of this
section, an area has a high population density if it meets all the
following criteria:
(1) The area is located in a county with a population of at least
two hundred fifty thousand (250,000).
(2) The area contains a census block (as determined by the
most recent federal decennial census (as defined in
IC 1-1-3.5-2) conducted by the federal Bureau of the Census)
that:
(A) has a population density of at least three (3) individuals
per acre; and
(B) borders or contains part of the river or stream.
(b) A person may not hunt for waterfowl on or along any part
of a river or stream that is within seven hundred fifty (750) feet of
an area with a high population density.
(c) The county executive (as defined in IC 36-1-2-5(1) and
IC 36-1-2-5(2)) shall:
(1) prepare or designate an official to prepare; and
(2) make available to the public;
a map of sufficient detail to indicate areas in and along the county
where waterfowl may not be hunted under subsection (b). The map
must be prepared not more than one hundred twenty (120) days
after the census block data has been released by the federal Bureau
of the Census from the most recent federal decennial census (as
defined in IC 1-1-3.5-2).

SECTION 2. [EFFECTIVE UPON PASSAGE] (a)
Notwithstanding IC 14-22-10-12(c), as added by this act, the county
executive (as defined in IC 36-1-2-5(1) and IC 36-1-2-5(2)) shall
ensure that the map that indicates areas where waterfowl may not
be hunted in and along the county is prepared and made available
to the public as follows:
(1) The initial map, not later than August 1, 2008.
(2) The revised map after the 2010 federal decennial census,
not later than July 1, 2013.
(b) This SECTION expires July 1, 2013.
